I was on a hill way of side of Rebel outpost. a heli landed and we started talking and apparently he could not hear me. I pass him a note saying can you hear me? my mic was working at airport so i was really confused. i tell him my mic is working. I start running to my heli to leave because obviously something is going on or they are just toying with me. I get met with "stop running " "hands up hands up" "hands up" i pull my gun and lower it. i then get met with "hands up or you will be shot" instantly i get shot from both parties.

I call them to TS to try and resolve it and get meet with hostility.

I would appreciate no TLC admin ruling on this.

Good Morning,

Well this is a first for me so here goes. This was a very difficult situation there was combat in the red zone between TLC and 183 and this had been going on for over 1 hour. When I arrived at the red zone edge I could see someone who was clearly spotting so went to question what he was doing, when speaking to him I released that I could not hear him so asked him if he was able to answer me at all. He never spoke to me so I toke this as either he was not willing to talk or he had an issue. He then began to move away from me and I was unsure what he was going to do next so I initiated on him. 

As the video shows it does not show my gang affiliation and it was explained by staff that this is a bug and can lead to communication issues within game.

He then began to run away from me and draw his weapon to which he was asked to place his hand above his head and was given ample time to comply, however he then drew his weapon and then lead to his death. Now from my side of things he was not speaking, or complying so therefore he was ready to fight so he was taken out by Flash. He did shoot early however in these circumstances I can fully understand due to no voice communications it was unsure on the intention of Burke and what he was going to do.

I can admit here that the initiation is not the best and I have been around long enough to know that, but due to the situation of the gunfight in the redzone and him pulling a weapon and his voice been transmitted, it was very difficult to judge and it was dealt with in this way.

I was asked to go to the 183 Lobby to speak to Burke about the situation, to which I did once I had finished my situation, upon entering the lobby there were many member of TLC and 183 in the lobby but my sole purpose was to speak to Burke about the situation however I was blamed of RDM ect before I even had time to look at the footage or even defend myself. Once looking at the footage I was unsure on the situation so asked staff members (not from TLC) to look at it and give an opinion. I then asked if Burke could be moved to the staff channels so that we could speak it out,  however after me attempting to apologies and offer compensation for what had happened Burke was not interested in any of the above and stated that he had decided what he was going to do and that was report me.

In relation to hostility and trying to resolve before asking staff, I believe that me explaining my view is not hostile but it is very difficult when you join  a lobby and you are jumped on and accused of something straight away rather than trying to talk it out.

I am disappointed about this report, I tried all possible avenues to resolve this but you seemed very disinterested,  I would like to offer you another olive branch to sort this out. I am not in the wrong here I have broken no rules. My initiation was poor but i did not act upon it. Like I said I'm more than happy to still resolve this with you so that we don't go wasting any time of staff or waiting for a staff verdict.

I will not be commenting anymore on this incident unless instructed by a staff member.  If you wish to resolve it, Please let me know.

I understand there was a miscommunication because of Ingame problems and we can not help that however your initiation was one of the poorest I have come across especially by a long term memeber such as yourself and for flash, flash did not speak at all and gave me no time to comply which is rdm/fail RP. Overall this is poor by both of you, why may I ask did you do this knowing that this is looked down upon (initiation) and why did flash give me no time to comply. You simply said hands up or die and what I’m getting from this you shot because I pulled a gun. You did not tell me not to pull a gun and i complied with your demands to stop or not. I pulled my gun and lowered it before you even said you will be shot.(not that I had time to comply any way)From the “notes” we passed you clearly know there was an i game problem that we could not do anything about so why would you initiate? so you would of not been able to do any hostage situation if I can not speak. I am not saying this is your fault here I am more worried that If this happens to me it may happen to other people, both of you here are in the wrong. You clearly did not care in the time or you would not have done it. I acknowledge you understand this is wrong however words can not make sure that these actions will be done again.

@PapaSmurphy and @The Flash, what is concerning me here is the fact you presumably identify through direct text chat that the player in question's mic doesn't seem to be working and there is a comms issue, yet you still decide to initiate on him and tell him if he runs off he will be shot, @PapaSmurphy, why did you decide to do this?

Clearly if a player's mic isn't working then the roleplay is severely limited. 

@The Flash you shoot the player, do you feel you have provided high quality roleplay before doing so?

This all happened a bit to fast for my liking. There was an active situation going on for over an hour or so  in the red zone and he was clearly involved, and could have possibly swayed the gun fight through the intel he was giving to his gang members via the spotting.

I am going to be honest I never looked at the direct channel, as the situation that was going on was happening rather quickly and I decided that I needed to remove the threat as soon as.

I was unsure if he was not talking or did not want to talk and was trying to get away. The intention was not to kill him but to remove him as an asset to the on going gun fight. My idea was to zip tie him and take him away, to interrogate him however he then has pulled his gun and this escalated the situation so I was put in the situation of its either him or me.

I believe this situation was not the best due to the circumstances as I have already stated above.

- There was a big situation going on with my gang and 183, and we saw burke at a distance and we thought he could be one of the spotters. so we decided to come to him and wanted to try to get some info and see if he was with the 183 gang. so we told him to put his hands up multible times, but then he pulled his weapon up that made the initiation change to I need you to place your hands up or your are going to get shot, so he pulled his gun up and at that time Burke was a threat to us so that is why i shot him. we didnt want this to happend that he got shot but he made himself threathening to us so we couldnt risk ourself to get killed.

- I can admit that the whole incident could have been better but I believe the circumstance of what was going on around us should be factored in.

- The reason that i couldnt come to their channel and try to sort this out is because i needed to go because that i needed to go to work. so i didnt have time to talk to them before i went to work.

- Im willing to talk to burke about this situation and solve this in a good way.

 
@PapaSmurphy and @The Flash, I understand there was a prior incident however this should not reduce the amount of RP given before shooting someone who is outside the red zone.

There are a number of issues here which I have touched on, if someone is having communication issues in game then please take these into consideration when deciding your actions. 

Regarding the actual incident of shooting, just because someone pulls a gun, doesn't mean you can shoot... if there was minimal RP and someone pulls a gun on you and they shoot you, they would be in breach of the RDM rule... there was 2 of you and only 1 of him.

I have checked both of your records and have no prior warnings, therefore this time I will give you both the benefit of doubt this time given the situation however I expect you to learn from the situation that this is not acceptable. I will be placing a one and only Warning on both of your accounts and if anything similar occurs in the future then don't expect any leniency.
