Myself and Stuart Barker got called to go to the pier by a member of the public claiming their friend had been dumped there. We used scuba gear to recover the wounded civilian and got medics on the scene upon arrival back to shore. Upon reaching the stairs of the pier, a car flew over with multiple injured people inside and dunked into the water driven by 798 (this is the dumping from EV1 Report). I chased the man in the water and presented myself and asked him to stop swimming, he then turned around and attempted to stab me with no roleplay. I stabbed 798 in the front and leg, downing him as shown in EV2 Video. I immediately brought him to shore and onto the pier, taking him towards the medics at the end of the pier when within started using /me "lost too much blood" and "no response" within 2 minutes of being down. I stopped running down the pier and dropped him and myself in line with a barrier from the rear to prevent any vehicles from accidentally hitting us. It was at this point that 938 rammed directly into me at full speed with no prior RP, with no sign of trying to slow down and even swerved around the barrier to my rear to hit me. At this point 798 continues to /me and eventually die (understandable after being run over and no means of quality medical help). Initially, I gave 938 the benefit of the doubt and assumed it was a very unlikely accident however I call 798 into discord to solve my issues of RDM and general poor RP. He claimed that he uses a controller to swim so couldn't use his push to talk mouse bind, that he did try to speak but was on whisper and didn't want to change mode "because it will slow down the whole interaction", he also thought that there was nothing wrong with his RP despite not saying a word. It was clear that this couldn't be resolved without a report.

Whilst liaising with 798, I noticed someone else joined, who decided to snigger regularly whilst talking about the situation, I then realised that 798 and 938 may have been together in-game and the man who was sniggering was 938. This liaison process was ongoing throughout the video provided in the report EV1 and when I read the report I realised that 938 and 798 were both involved in the events leading up to the dumping at the pier. Furthermore, I realised that 938 deliberately ran me over to save his friend without any prior roleplay constituting RVDM. Moreover, I noticed that 798 had not used his radio once during this interaction and yet 938 somehow managed to position himself perfectly to drive all the way down the pier at max speed and hit me, without even being present at the scene at any point or driving up the pier with no way of knowing his friend's immediate location and status. Adding to my suspicions was that I have come across 938 numerous times before and the people he associates with, I have heard hotmic'd discord conversations through their mics and I have never seen them talk on a radio. I have additionally liaised with them before about metagaming and other rule breaks.

Moving on, I decided to look at some more of the videos 938 has uploaded to the report a player section, again never seeing him use radio and every video has his mic audio removed, or his discord audio removed or even silenced sections of video. Some examples are:

(02/06/22) EV1: 05:54 - Discord liaison between me and 798 which KARL was listening into is removed through the entire clip, however at the timestamp, you can hear him leave the channel and join a new one with someone else in the channel/call.
01:22 -01:42 - Discord liaison conversation on extremely low volume but audible during this time, Karl johnson's voice display is showing but you cannot hear any audio from his mic until 01:42.

(01/06/22) EV3: Karls mic audio is present throughout.

(26/05/22) EV4: Karls mic audio is present throughout, discord audio is removed and the undeafen sound can be heard at 03:56.
04:59 Discord sound plays for someone watching his live screen.

(10/05/22) EV5: 01:39 -Discord sound plays for someone watching his live screen and mic audio is removed throughout the video.

Overall I see this as a clear case of RDM from 798 with disregard for G4.4. As for 938 clear RVDM.
As for the OOC info for both, no solid proof, just plenty of circumstantial evidence for it as well as the clear editing of footage being uploaded to the report a player section.

You're right, I do know 798 however that doesn't prove that we were metagaming or using OOC information. Secondly, it's not against the rules to be on Discord or use Discord whilst playing RP. I have never used Discord to play to my advantage nor did I during this interaction. We do use radios and we use them frequently, just because you haven't seen me use a radio in the few times we have interacted doesn't mean that we don't use them. Also you can't throw in accusations that you have heard hotmic'd Discord audio when speaking to us before when there is no evidence of such, so this should be disregarded. You also have never liaised with any of us about metagaming or other rules breaks, you're not staff and we have never had a situation that's lead to needing to talk OOC during my time of playing this game.

798 was going to dump people at the pier this was discussed when I put those people in the car he took them in. After a while I had not heard from him so I thought he might have been in the water for too long and not surfaced. At which point I drive to the pier to drive off in order to look for him in the water. I drive on the pier as fast as possible in order as big of a jump as possible but I then hit "Ollie" I stop straight away and get out of the car, with no intention to get away as I knew I had hit someone, it was only at this point I noticed that my friend was on the pier. I stayed the whole way and even apologised to "Ollie" as he came closer to me. Even when I was out of cuffs, I did not try to get away in order to do everything I can to not be accused of RVDM as that was not my intention. 

Also, whilst you were liaising with 798, I did join the call but I went on mute instantly and was muted the whole time I was in the call in order to listen and speak if I needed to. I did not snigger, so don't lie about me in order to make your report more plausible. I never ended up speaking as I then got involved in a scene in the game so I left the call.

Finally, I'll address the "evidence" you are referencing. In none of the clips are radios required, my mic audio isn't removed, SP wouldn't pic up my mic audio initially however this has been fixed and in subsequent clips you can see this being picked up. My Discord audio isn't picked up in my clips either as I have a split audio headset and my game is picked up through the game track and Discord is picked up through the voice track. SP only picks up my game track as that is why I use clips.

(02/06/22) EV1: 05:54 - Discord Liaison audio isn't removed, it was just never picked up as I mentioned above. 01:22 -01:24 You can hear the Discord Liaison call, which proves that I haven't removed the mic audio. The reason you don't hear my mic audio is for one simple reason, I didn't speak but I was holding my push to talk button ready to start talking, before I even got a chance to speak I got stabbed. 

(01/06/22) EV3: Not sure what kind of evidence this is but yeah my mic audio is picked up because the issues that I had with my mic audio from previous reports had been sorted. 

(26/05/22) EV4: Discord audio isn't picked for reasons mentioned above, but there isn't any reason for radios needed here or why I'd need to use Discord here. live screen is played for my friends who enjoy watching me play the game. I don't think streaming is against the rules.

(10/05/22) EV5: live screen is played for my friends who enjoy watching me play the game. I don't think streaming is against the rules. Mic audio isn't picked up as SP wouldn't record my mic audio but this has now been fixed.

Also EV4 and EV5 can't be referenced here as they are way over 24 hours ago.

Im not going to turn this into a long debate, staff can review evidence to decide but i'd like to make a few thing clear.

• In EV2 798 was chased under the pier, downed and brought up to the pier before I was run over, it took 3 minutes from me chasing him for Karl to arrive and down me. So within those 3 minutes you came to the conclusion that he drowned, and made way and arrived at the pier, seems you made quite the assumption within a very short timeframe of non-contact. Also why did he not radio you or you radio him for help? 
  
• In EV2: you can hear Karls vehicle swerve directly into me to hit me from behind when there was a hard bench a short distance behind me. This was clearly deliberate and you played this off as an accident. The  reason you stopped was because you crashed  into a bench and blocked in by police cars. 
  
• Karl claims his game recorder only picks up his game track, yet you can hear discord notifications in EV4 and EV5 which are played as a seperate audio mix through discord.
  
• Discord uses two audio mixes in windows one for notifications and sounds, the other for audio. You cannot have one of these mixes without the other unless you are removing one intentially.

So, not sure why this ended up being reported since we discussed on discord but okay. I did drive down the pier to dump a bunch of people and low and behold there are police at the end of the pier. All i know at this point is that i will be getting arrested if i am caught. Because of this, i decide to swim away. However, I hear right behind me in the water "armed police stop". I look behind me and see the police officer chasing me under water. At this moment i realise that i will probably not outrun the police. As a result of this, i pull out my knife and decide to try and fight the officer underwater. I end up losing the fight, taking a stab wound to my neck/head area. The officer escorts me out of the water up to the pier to try first aid. However, as a result of the stab wound to my neck/head area i have lost too much blood and I am unresponsive (This has been a similar case for previous incidents i have been involved in and i have had no issues with these incidents). I had also died underwater so taking into account water entering lungs etc. As for the whole talking interaction, first of all, we are underwater so i am not sure how talking underwater is proper RP. However, that does not mean that i did not try to. I did, but i was on whisper so i am not sure that he had heard me. Also, i play with both my controller and keyboard/mouse switching between the two when necessary. My keybind for Push to talk is on my mouse. When i was underwater, i had picked up my controller as it is easier to control my player. I could not talk during this knife fight underwater. This is my statement for the 'poor RP' i was being accused of.

As for player 938, i do know this player. We had killed a few people together and i was the one that was going to take them down to the pier to dump. He was aware of this. I had also told him that i will radio him in when i have done this, so he can come pick me up. As i had died, i could not radio in. I can only assume that player 938 had come to the pier to search for me as he had probably thought i have died. As a result, me and the officer did both get run over furthering injuring me (Had no response due to stabbing anyway). I ended up being killed off by a medic and respawning in paleto.

Also, i could not radio in 938 at the time of the fight... as i was in an intense knifefight. I had the police officer on my tail the whole time so everything i was doing in that moment was crucial. I could not take my focus off of this.

I do not know why the interaction of 938 being involved in this was not mentioned in the discord either. 

And just to be clear, I did respond to the OOC that was aimed at me - hence the conversation in discord.

Those videos have been privatised as they are no longer relevant, and as they belong to me I have every right to privatise my video as it belongs to me. Secondly, you have re-uploaded my video to your YouTube channel. As the video is my property, you are infringing my rights by uploading it to your channel, I will ask you to delete this immediately and I have submitted a copyright takedown request for both videos. You don't have permission to re-upload any of my videos again.

3 minutes is sufficient amount of time to be worried that something has happened to someone considering we were close to the pier to begin with. I was also supposed to get radio response from 798 to pick him up when he was done, however I didn't further confirming my suspicions that he had not surfaced. How do you know I didn't radio him to try and get in touch with him and him not radioing me was exactly why I went to drive off the pier to help him. Again, not sure what your point is with any of what you're saying in your second point.

The BMW M135i has notoriously bad handling and braking, you hearing me swerve is not evidence that I intentionally tried hitting you and it is an accident. Tiny inputs in the keyboard causes this car to slide and swerve, go drive it to find out for yourself. The reason I stopped is because I realised I hit someone, I straight away realise I hit someone and brake, again the brakes are shoddy on this car, even after one police car rams me, I still could have driven off as I'm pretty sure the car was facing either the edge of the pier or the city. But I got out and tried to apologise to you so don't dictate to me what I did or did not intend to do.

I'll address points 4 and 5 together as you're saying the same thing. First of all, are you an audio engineer? I very much doubt it because it seems like you don't know what you're talking about so let me break it down for you. My PC audio is split between "default system device" and "default communication device." I will refer to them as "DSD" and "DCD" from here. Everything on my PC uses DSD, the Discord app also uses this for everything except any voice communication which uses DCD. SP only allows you to clip DSD audio, hence why you can hear the Discord notifications sound but not any voice channel audio. Again it is not against the rules to use Discord whilst playing this game. In conclusion, you can have separate audio mixes, and my screenshot below can prove this. And I'm not an audio engineer either so I couldn't intentionally* remove the audio track even if I wanted to, especially considering the short periods of time between the incidents happening and the reports being made.

I like how you didn't address the lies from your initial report that I highlighted, like saying I was sniggering in the Discord call when I wasn't and saying you have liaised with me before about metagaming and other rule breaks when we have never had any conversation of the sort.

Again im not here to argue irrelevant points hence why im not gonna argue about the discord laughing etc.

As for "copyright infingement" the video you have posted shows gameplay of Rockstars GTA5 with no transformative content, futhermore the copyright is with Rockstar, not you so unless rockstar want to file a DMCA takedown the video will remain. The fact you are striking these videos speaks volumes. 

As for your audio, as i explained discord has two audio mixes https://gyazo.com/4aa0b39e1f7993bd587e09a4664036d2 , one for notifcations one for voice audio, when you use "split audio" the discord notifcations come through the communication device, the same as the voice mix. Futhermore if your using a recording software, it will record both because they are under "communication device"  or neither if its just recording the games sound track or the game and system sounds mixes. I invite the staff member reviewing this to set up split audio like Karl has shown and test on discord where your voice and notifications come out from, it will be the communication device for both. 

Also Jorj you where reported because when I attempted to resolve you did not admit any wrong doing, thought what you did was fine and made ridciulous excuses for providing poor RP, hence the report.

YouTube clearly disagree with you, they have approved the copyright takedown request and me requesting it to be taken down doesn't "speak volumes." I am literally protecting my video content which is my right to do so. 

As for my audio, I've made it clear why it is set up the way it is. I'm not going to keep repeating myself just because you seem to be struggling to comprehend the way my set up literally is. Also if I'm intentionally deleting audio from my videos, why would I not remove the notifications sound too to stop raising suspicion? I'll explain why, because I'm not intentionally removing audio from my videos nor do I have anything to hide so it would be unnecessary for me to do so. Staff, we can go through extensive testing together to prove my audio is set up the way it's set up but it will be a futile endeavour. You can see in the screenshot that my headset has to different outputs "Astro A50 Game" which is my DSD and "Astro A50 Voice" which is my DCD. I thought I would highlight this for you and Richard as it can be hard to notice.

Alrighty,

So i took me a while to get through this, but let's see what i've come up with. Firstly, the issue that caused this whole report.

798 - this video clearly shows RDM on your part. Before starting any sort of fight you have to make sure quality RP is provided, no matter what. This is a roleplay server, not a MMO-RPG with voice.

When i was underwater, i had picked up my controller as it is easier to control my player. I could not talk during this knife fight underwater.

Right, so you are quite clearly stating that you didn't RP because it was easier not to. Yes, of course it's easier not to RP, but at the end of the day this is a RP server and as such your focus should be RP, not winning. This just clearly shows a win mentality on your end, you'd rather not talk and stab someone rather then RP properly and have a chance of loosing because it's harder to control. This is also shown but you instantly doing the /me things as soon as there is a risk of you getting revived and arrested. Yes, realistically the chances of you being able to speak after what happened there are low, but keep in mind that there is a lot of situations where IRL you would be dead right there, but people still roleplay for the sake of roleplay. You may say that you are doing this to increase realism and what not but let's be honest here, you took a short cut by not speaking to the cop before stabbing him and you took another shortcut by using the /me to easily get out of a roleplay situation. Next time at least act like you are still alive for a while, speak to them and RP properly that you are dying.

938 - Ok, this took me a while of thinking, but here it is. Let's break this down, so you say you were worried about you mate and that's the reason you wanted to go fast so you could get a decent jump off the pier. Firstly, if you actually did that i would be tempted to call that fail driving. You wouldn't just casually do a huge jump with a car into the water to look for your friend. You would be stunned quite a bit after that so if you ever find yourself in a situation like that, don't do that. I also noticed something, the angle of your attack on ollie. It is clear you were actually aiming for him. As there was no RP provided, either by you or your friend, this is just RVDM.

Now, last thing @Richardd- what caught my eye in the video is what happens right at the start of the underwater chase. At around 3:22 you lose sight of the guy you are chasing. Instead of looking for him properly you decide to press your session ids button and locate him easily since those ids show up from quite a distance. This is simply exploiting. The fact that you did that instantly as you lost sight of him hints that this is not the first time you have done this. In fact it looks like it's your usualy method of finding people.
