What best describes this incident ?: Emote Exploiting + Possible NVL

Please (in detail) describe the incident: A cutlass member was running away from us as we was bashing and chasing them down, we surrounded their car and the guy got out and ran away even though we was telling him to put his hands up , this isnt the main point of the report but would like to point that to understand the full range of what NVL means in the staffs eyes

The main reason of the report is that we was looking for this guy in the sewers he jumped into after we told him to get out with his hands up , and we couldnt find him, at first i thought he might of logged off , but i went down to look again and i couldnt , so as i was about to go and meet my gang i drove past a shape on the floor and i had a feeling it was him , and it turns out that he decided after running away from us that he could do the sleep emote with half of his body inside of a wall to hide from us, i think that is completely unacceptable , i shot at him as i saw something in his hand and we also managed to get 3 of the other cutlass boys , we wanted them dead.

if him running away from us at the beginning isnt NVL can you please explain why just so i know for future reference.

in my eyes I was sleeping but wasn't inside the wall, as you can see as soon as I saw you noticed me and reversed back I instantly got up then when you pulled out a gun I put my hands up

 
I shot you 2 times before you put hands up and you also heard on the radio that if we find the guys who were running , that its kill them on sight, can you show the clip of your eyes of not being in the wall, because its very clear to us there that you was half way in the wall in my eyes.

either way you decided to run from all of us and sleep next to wall instead of hands up like we said to do. i will not be replying and will let staff decide.

As for the Value of Life claim of this report, in this specific incident. I cannot see ID 391 at an obvious disadvantage. Clearly, he is outnumbered as there is more of him than there is of you. However, the player is not met with a threat or anything obvious as I watch the clip. I don't see any weapons pulled and I doubt he does either. All that he and I could hear would've been the 'Hands up' but in itself without any visible weapons drawn towards the player, he isn't going to stop. If you had pulled up and surrounded his car with obvious weapons drawn and told him to put his hands up and initiated roleplay that way, and ID 391 still decided to run off then that would've been a clear breach of the Value of Life Rule.

I have reviewed the footage that Kina has provided which shows @ImCloudNineusing an emote to 'hide' from his pursuers, ID 391 can be seen doing this emote half in the wall and half not at 1:52 and again when Kina found him 4:04. Emoting to hide is fine in itself but when you're half inside a wall and half not, it makes it very hard for people to find you and doesn't make sense on an RP server as its not exactly realistic?

Please make sure that your whole body is visible and you're not half in a way if you ever find yourself in this incident again as this will be an informal warning. @ImCloudNine

In regards to you @Kina, shooting a player on sight with minimal RP is not something that we want here. Please ensure you're giving high quality RP at all times. Yes ID 391 ran away from you but I can hear others state 'Its on sight' and when you approach, you have you pistol ready and began opening fire on the player. This is a Roleplay server, not a TDM server. Act accordingly please!

Your report has been dealt with, but perhaps not in the way you originally envisaged.

Whether this is beneficial or disadvantageous to you will depend entirely on the situation, and staff will have taken the most-appropriate action in the circumstances.
