Unban Appeal for Smackywacky_

In-game Name: Smacky. (David Bailey)

Server: GTA RP

Steam ID: 76561198272177769

Ban ID: rpuk6847

Reason given for your ban: C2.2 Exploiting

In your own words, please type why you think you were banned.: I am aware of why I have been banned after finding the report and the evidence provided. I have been banned for cancelling the emote whilst dealing drugs. Please see below before coming to a conclusion.

Why should we unban you ?: I have been a part of this community for a very long time going back as far as 2020 and as far as I am aware I have no warning points during this time. I am a committed player and I have never broken the rules knowingly. I have read the FiveM rules and have completely missed the general community rules. In many of the cities that I have been in there has never been an issue with cancelling the emote as the emote in general lasts around 2 seconds and by the time you have cancelled that emote the emote would have been over anyway. As you can see from your server logs, I have been absent from the community for quite some months whilst I have been exploring other communities to see which one I would like to settle down in. This is one of the communities that I have chosen. As stated I have been a part of the community for many years and have never had a problem. The instant thing to do when you're being watched by someone is to get away from the situation and in real life, you wouldn't continue with what you were doing, therefore, I do feel this is a slightly unfair ban. If I was someone that was new to the community and had been repeatedly breaking rules then I would fully respect this ban but this is a completely different scenario. After talking to a friend after I've been banned, they have explained to me that they were issued a warning for this in-game and have not received a ban instantly, yes they are newer to the community but that doesn't mean that they should be treated any differently. In the initial report here: https://www.roleplay.co.uk/topic/136870-report-a-player-78-gta-rp/; there is a question that states 'You tried to resolve the situation with the player(s) before reporting:' and they have replied with 'yes' This is not correct. I would love to see the evidence from their side as they have not tried to resolve the situation with me, they have come straight to report me. I believe that this is not fair and I should not be the only one punished for this. Yes, I am in violation of the rules but to give a permanent ban to someone who has been a part of the community for so many years and never had any issues, it's simply not fair.

I would appreciate it if this ban could be shortened or removed, please.

Please confirm that you have read the unban appeal process and rules: Yes

Are you sure you have read this?

Yes, I am in violation of the rules but to give a permanent ban to someone who has been a part of the community for so many years and never had any issues, it's simply not fair.
"(C2.2) Exploiting - Using or attempting to use any exploits in any of our community game servers such as but not limited to duplication of items or money, transferring/processing items through walls and windows or bypassing intended animations. Punishment is a permanent ban without appeal. If you discover an exploit that nobody else knows about, please reveal it to a staff member privately in order to ensure that it does not get abused in the future."

So please explain why you think that you have been unfairly banned. I will not except an answer of "I've been here a long time" as an excuse.

Hello there,

Thanks for your responce.

I can confirm that I have infact read the 'unban appeal process and rules' before coming to the appeal section of the forums.

I personally belive that I have been unfairly banned because I have heard from others after my ban has been in place that they have been issued a warning for this matter and I have never been told otherwise.

This is a silly mistake and I am not looking for any simpathy with this. From what I can see there are a lot of other people doing more serious rule breaks than this such as abusing hunting. I fully understand that I am in breach of the rules and I have admitted to this but I would ask for some thought to be put into this. I can assure you that I am not the only one that has been caught doing this and they have been issued a warning for this offence. I have received nothing other than an instant permanent ban. As mentioned in my first message I personally believe that everyone should be treated the same and in this case this has not happened; before any conclusions are made, I would like to ask you to put this into concideration with the evidence provided and also the reporters claims that they 'tried to resolve the situation with the player(s) before reporting: ' they stated 'yes' this is not the case, in their evidence you can hear them say 'let's not do that' and that is all they've said, this is not attempting to resolve the situation. This is the only issue I have had on RPUK within the last two years (6 months of playing) and believe that I could better myself from this matter.

I am not saying that am completely innocent as that is not the case but I would like to have some consideration with what other players have done and the situation I am in. I would be fully happy for you to wipe my characters and for me to start from the ground up and I am offering a cincere apology for the breach in your rules.

Many thanks,

Smacky.

You are correct it is a silly mistake. But this is where the issue lies. You have decided to go off from what people have said and therefore coming to the conclusion that you have been "unfairly banned" You cheated by exploiting and since you can't see that being a problem it's a big enough problem for your appeal. Think you need some time to reflect on your ban before you appeal it.

Denied. You can appeal in a week after you have taken time to understand your ban.
