In your own words, please type why you think you were banned.: First off, I'd like to say that this has come to some surprise. With this being for G4.3 that would mean that it would be for something involving my character being kicked by The Lost from their club. Now, I've been very careful with my character and who he talks to and whatnot. PJ over the last 2 weeks has spoke to a total of 2 members within The Lost, one of them being Roman Shekel and the other being Eddie Sixx. Roman I spoke to about buying a car and Eddie I spoke to about selling a business to him in character.

I honestly have no recollection of breaking G4.3 and if I had I would hold my hands up and admit to it. I can't think of anything my character has done within the timeframe of me leaving The Lost and now where I have spoke about, or spoke to members directly involving things that my character shouldn't remember.

Why should we unban you ?: I feel as though I haven't broke the G4.3 rule at all and I have no recollection of doing anything wrong? Also I hadn't been banned previous to this for over a year and unsure as to why this wouldn't be a 1 day ban under FBS rather than a permanent ban. I wish I could at least speak to someone regarding the matter rather than having no clue to why I've ended up in this position? Because right now I'm under the impression that my character has stayed well away from The Lost and their members until a situation in game comes up where I would eventually get to know them all again.

Hello PJ. 

The moment you had your Lost MC vehicles, previously parked in the Lost MC compound transferred to Vanilla Unicorn, you broke New Life Rule. 
According to the rule, you shouldn't be aware of these vehicles existence after the moment you were killed. 

The reason this ban is permanent rather than temporary, is due to a pending retrieval of said assets, to revert the 'RP' to where it was left off and prevent a 'domino effect' of events, later needing staff to resolve, such as the sale or use of the mentioned assets.

With the above in mind, would you like to explain your reasoning behind having a mechanic transfer these vehicles to Vanilla Unicorn?

Thank you for such a quick response regarding the matter.

I was never told that the assets I had was meant to go back to The Lost and thought it was something that had to be sorted within roleplay. I bought those vehicles whilst in The Lost MC from Custom Motorcycles so surely they'd have to come to me within roleplay to retrieve them? My character has no clue the bikes are exclusive to The Lost MC. I asked the question about the bikes within a teamspeak call with staff and they said that they'd probably be retrieved within roleplay. If I had any intentions to sell the bikes and ruin a relationship between The Lost and PJ it would have been done already as it's been over 2 weeks since I was kicked from the group.

My intentions to move the vehicles were that I had seen them on my vehicle finder app on my phone at the time and wanted to move them to a storage that was public so that I could access them again. I'm not planning on going to The Lost compound to get them back, I'd use a in game feature which is the mechanic transfer. If there was any malicious intent, surely that would have happened by now? 

Not once had I thought that moving a vehicle that was in my possession just because it was an exclusive bike was NLR. The bikes I got through a dealership which yes was owned by the club itself but what made that NLR? Would I then not own a car I bought from luxury autos if Roman Shekel was to kill my character and he'd have respawned.

 

(G4.3) When you respawn and NLR applies: 

  • Your character does not remember any of the previous roleplay situation. 
  • Any feud your character had with their killer(s) is ended. 
  • If your character respawns as an exit strategy from a relationship then the relationship dies with them. 
  • Your character must not return to the location where you died/bled-out for at least 15 minutes. 
  • Your character must not re-enter the situation that caused you to respawn and must excuse themselves from the situation if they accidentally enter it.

The rules state that I shouldn't remember any previous situation regarding The Lost MC or of any previous roleplay I had with them, so what would my character have against moving some bikes that he had in his possession and still on his car finderz app? Sure if I were to go around on the bikes shouting I was a Lost MC member but they're parked in a garage?

I have a video of the entire night where my character was killed and not once did anyone from The Lost MC take my vehicles from the personal parking at all, I had a mechanic move them as they were on my car finderz app. I would have thought this to be a roleplay issue rather than a rule break. I bought many vehicles whilst in The Lost, it doesn't make sense to just be the Lost exclusive bikes that is what I shouldn't remember buying. If I bought it in game, legitimately, then surely my character has to have those things taken within roleplay.

If what you're saying is true and that moving the vehicles after the removal from The Lost true, then why wasn't it told to me? A simple 'Don't move the bikes until they get data transferred' instead of what's happened now? I understand rules are in place for a reason but I had no ill intent. The bikes were moved the night that I had got killed, all the bikes that are exclusive are still within the garage and nothing has happened to them. If I had any intention to sell the bikes to anyone else then that would have happened already. The bikes would have gone back to The Lost either way, through RP or through OOC methods so a simple warning I think instead of a permanent ban since I had no intentions to give the bikes away and haven't done anything with them for over 2 weeks now.

Also just to clarify when doing the data transfers, the 'Sanctus' was bought years ago, before I joined The Lost MC so that bike shouldn't be transferred back to The Lost. Every other exclusive bike was bought from custom motorcycles.

Why move them in the first place?

Your character should not have any knowledge of these vehicles, due to NLR. 
They were purchased as a member of Lost MC, a time of which you have forgotten about, as per NLR - Your 'PJ' was never in the Lost, so how would you explain within RP as to having these assets? 
Just as you would forget about the members of Lost MC, you'd forget about the assets you once had there - and just as you'd be expected to ignore any previous relations you had with them, you are to ignore the fact that you technically own vehicles showing on the 'Car Finderz' app. 


The "Roman Shekel and Luxury Autos" argument doesn't work here, as that'd be personal vehicles contra 'faction assets'. 
The Lost MC vehicles you purchased as a member, belongs to the faction. They are "in your name" for convenience sake mainly - I'm sure you're aware of how this 'contract' works?


 
Like I said before, they were moved just like most my other vehicles to a public car park, I didn't think much about it at the time because I had no intention of using them. Transferring those vehicles didn't hinder any roleplay at all and I hadn't once told anyone that I was selling those bikes.

If I had been told prior, that those vehicles would eventually be taken back via data transfer and that I wasn't to touch them then I wouldn't have, but I've not done anything with them either way, other than transfer them to Vanilla Unicorn. Not once have I got the vehicle out and started riding round on it. 

All this could have been prevented if the vehicles were taken when the mayhem vote had been passed, or even warn myself of the vehicles going back to the club. Like I said before I've not had any ill intentions with the assets and didn't have any bad blood with any of the lost when I was kicked so I had no reason to do anything with the bikes other than keep them stored away.

 
Right, here's what'll happen PJ.

The assets are pending to be transferred from your PJ character, back to the Lost MC. (Excluding your Sanctus, owned prior to joining Lost MC). 
Once this has been completed, the ban will be lifted. As per the FBS, it will not count towards it as a permanent ban, but rather as if it was a 1 day, meaning any ban within six months would follow the FBS ladder from there. 

The moment you transferred the Lost MC assets after being killed, you broke NLR - thus, the ban (G4.3, C1.7) will remain on record.

 
I appreciate you informing me what'll happen. I know this is kind of a unique case regarding the rules, but I can assure you I always try my best to stick to them and make things enjoyable for both sides during my interactions with people.

I know unban appeals are lowest on staffs priority and thank you for the quick responses regarding this case.

I trust that you understand and wont make the same mistake twice, the assets have been transferred and you ban lifted.

Ban reverted to a 1d ban, in terms of FBS.
