Please (in detail) describe the incident
Whilst driving my box truck, with lights on, down the road, I come to a bend in the road and see about 3 ft infront of me a large tempest without its lights on. I make best effort to swerve out the way, the tempest however keep going straight for me in the middle of the road, and infact moves onto my side of the road at the bend, hitting me and blowing me up.
I will admit, I was not perfectly driving, I may have been a wee bit in the middle on the lane as I approached the bend, but by and large, was on my side of the road, and I am happy that I was obeying the road laws to the best of my driving ability. Upon seeing the vehicle, who sees me down the road with plenty of time, I swerve off to the right, so as not the hit the vehicle. The tempest makes zero attempt to move to its side of the road, despite seeing me with plenty of time, and moves onto my side of the road as I approach the bend.
I have attempted to resolve this with Tyson via a member of member support. He maintains that I am at fault for not swerving out of his way, despite me driving on the correct side of the road; he also maintains that there is no rule saying he cannot drive in the middle of the road, and that he had no issue with me taking this further. Hence, the report.
