Please (in detail) describe the incident

So i was flying a helicopter and following a UNMC ifrit to see were it was going. It was heading towards the UNMC lands and we wanted to make sure they returned it there and not start anything unnecessary, other officers was told not to do anything for that reasson after following them for a while they stoped unsure for reason and sprayed the helli. They claimed to have sent 2 ATC's but that they werent recived even tho they had at least 4 other aircraft that also would have recived them. YET we were sprayed out of the air.

The video is from we took off in the helicopter from NPAS and untill we were shot out off the sky.

So I was on the bench of the heli, I sent the first ATC, then another, then another, I wasn't concentrating too hard so I didn't notice the fact that we did not get the ATC, I thought at one point 'oh maybe only pilots can see'. Now I sent another 1 or 2, along with another UNMC member, essentially saying 'final warning'. 

I was told to shoot the heli down, I then asked 'wait did anyone get an ATC' as it suddenly clicked to me (after I'd shot), to which they said 'oh no' we didn't. This was an honest mistake, to prove this I got Raptor to make a video showing the ATC's were not working as @TomTheDoge asked me to send a video proving it by sending an ATC whilst in a heli with the message '//test'. 
You can see that even as the pilot, he received no messages.

By this, &lt;21:16:19&gt; "TikTak [KV380]": Not buyuing it, I assume you're implying that I was either lying to you or knew about the ATC's not working pre-you getting shot. I can assure you, I was not aware, and the video show's I am not lying.

Clearly there have been some new issues that have come about since the last update, vehicle skins have reset + appear as different colours to others, you guys yourself spoke about the sirens not working in the video. The ATC script is clearly broken. At least for the UNMC.

[SIZE=14.6667px]I've been in this community for over a year now, I know the rules of shooting heli's down, this was a mistake, and a huge server issue. Regarding the other helicopters the personnel inside were muted as they were roleplaying, so they wouldn't have known about the situation regarding me sending them anyway.

I can only apologize once again, clearly, you weren't interested in hearing what I had to say.[/SIZE]

Okay so, first of at the momment of this incident you had atleast 3 aircraft in the air (2 MH-9, 1 Jet and possibly a Blackfish.) Yet none of you noticed that  none got a popup for any of these so called ATC's.

Secondly, you have not provided any form of proof that you sent any ATC's at all something i would highly  suggest we get on the table. 

Thirdly, it is YOUR responsibility to make sure that you properly innate and you were in a air vehicle yourself and would easily see that you dident get your own ATC. 

Simply you can not blame this on a bug and get it over with, you had so many warnings that something wasent working you yet decided to shoot. Your bullets, Your responsibility.

I believe the unmc are not the only people with this atc bug as by the sounds of this ^^ he recieved no atcs either, really think you were to quick to decide to report Tiktak you even went afk in game straight after to write up the report while medics and unmc tried to rp with you...

Right so as I've mentioned before, those in the blackfish had prisoners and also medics, @CST Alfred H and @CMO Norman can confirm that they were talking in vehicle chat, the pilot and other UNMC members were inside and MUTED on TS. I was in one of the MH-9s. For the others, I have no idea if they were UNMC or aware of me sending ATCs, like I said, I wasn't really concentrating, I was sending ATC's and looking on my phone. It's never not worked before so I guess I took advantage of that? 

It is my responsibility to ensure that I properly initiate on a heli, it isn't my fault if there's an issue with the server at the time that prevented it. It's your responsibility to try and resolve things as a staff member is it not.

For your last part, I've said I wasn't concentrating on receiving the ATC as I wasn't looking to gain any.

Like @Reece Smurf said, after i'd realized (see at this point i'm in-game concentrating) I said to the other heli, oh btw which I do remember had actually landed and I believe everyone had jumped out, so no ATC's, to go over and RP with the cops and explain within RP that our radio comms had gone down and prevented us sending them a message, as well as a //.

In regards to evidence, well it'd be nice but ever since I did a full PC refresh, unfortunately, I haven't set it up. Convenient for you, but do you actually think that I, would actually spray you down for no reason? I mean come on.

As Tommy said, I can confirm on behalf of all the passengers of the Blackfish that was up at the time, that all 3 UNMC pilots/co pilots (the only people who could receive the message) were roleplaying with us and talking to us for the majority of the flight which I imagine makes it difficult to notice a tiny ATC msg, besides this there is the fact we must have been at least 500m up and travelling at 500km so any ATC message received would most likely be ignored anyways due to it not being relevant, and even if they did see it I doubt they'd questioned it either.

Myself and @Mattch Will be reviewing this report and the outcome will be posted later today. If either side has any more evidence or anything constrictive they would like to add please PM either one of us.

After reviewing the report in question we (Myself and @JohnJoeegan) have come to the following conclusions:

1. While we understand that it may appear to be a case of RDM, it could easily have been resolved by discussing this with Tommy at the time, rather than just closing the conversation.  While we don’t require people to resolve anymore, we still do highly recommend people at least try before making a full-on forum report, as staff I’m sure that you’re aware of this.
    
   
2. At the time of the incident neither side was aware that the ATC system wasn’t functioning, once a bug report was made it was acknowledged by the dev team and a compromise was created while the system is being fixed.
    
   
3. It is not up to the person being reported to provide evidence of their actions (although if possible it is appreciated), again as staff I’d hope you’re fully aware of the fact that we’ve always maintained that it's the reporter's job to provide the evidence. 
    
   
4. As per the server rules (3.8.1) and (3.8.2), as far as we are concerned the UNMC did take all necessary actions that were required to initiate on you at the time. They were only required to send the 1 ATC message clearly identifying the target and any intentions.  
   Obviously, now that we are aware that the system is broken this is no longer sufficient, but at the time, they had no reason to believe otherwise.
   
   Once the dev team has fixed this current issue, we will bring the rules stated in our response up at a Staff rules meeting / Staff meeting as we feel that these need a bit of clarification / cleaning up.
   

Because of the points stated above the report will be rejected.
