Please (in detail) describe the incident

Ayrton and myself were in a helicopter looking for something to do. We saw that a fuel station was being robbed so went to investigate.

Upon arriving we notice that there are a few guys set up outside the gas station, clearly in support of their friend who is inside robbing the Gas station.

We hover over the area can faintly hear them shouting “fly away or be shoot”. At the time, we are unsure if they are talking about us or the helicopter. Hence the conversation about warning shoots.
We clearly heard them initiate on the helicopter or us not sure on which they meant. However, we were both killed.
Ayrton from gun shoots and myself through the helicopter crashing.

The rules I believe them to have broken are;
(7.1.3) Killing someone must be carried out with high quality roleplay, “put your hands up or I will shoot” etc is considered low quality RP and may lead to a ban for RDM/Fail RP. Executing another player must also be carried out with high quality roleplay, the only exception to this rule is if both you and the victim are engaged in a gunfight together.

An execution with just saying “I’m going to pistol you” is poor by everyone’s standards.
We tried to get in touch with them via OOC but they did not answer our message.

i'm commenting on this early for a reason and i'm quite interested to know why you have made this report? 

You brought the video to myself in staff help 1 yesterday and asked for my opinion, you made it quite clear that you wasn't going to report the people in this video. Why the sudden change of mind? 

 
That is correct, I did come for your opinion and you were a great help in clearing up the idea I had of it being RDM. Correcting me to the right rule break.

However you did say that it was a terrible execution and you would ban him for this. I clearly stated to you that I had no interest in getting him banned for what he did. 

However as I mentioned to you that I was very much interested in being  re-embarrassed for what I had lost. 

Now I was not able to get in touch with them after as my friend tried in OOC and we looked for them in TS. Also no sign of them on Discord. I choose to raise a report as the only way to my knowledge of getting compensation for my lose is to do this. 

I may not of been clear enough to you in my intention of retrieving lost items but I know that I said this. 

Like I mention above your advise was good and it was well received. You confirmed to me that his actions were wrong and you would ban him for them. I took the advise you offered and decided on posted this report particularly of the back of that. 

I hope this clears up my intentions. If not I'm more than willing to clear up any areas you need me to or I can join TS at some point to discuss further. 

 
I have now spoken to the guys involved and this has been resolved.

It's not resolved yet, because I have a few questions for you.

You hear them order you to leave and they made it clear what the consequences would be if you didn't. You all heard this because more than one of you repeated it to each other. They said it many times, and it was a whole 35 seconds from their first warning to when they actually fired.  That's far and beyond what we as a community deem as 'enough time to comply'.

Why then, in your lightly armored and open cockpit  heli, knowing they intended to shoot did you fail to comply with their orders thus putting the lives of you and your passengers at unnecessary risk?

The problem I have here is you seemed more interested in rule play debating the altitude in which server rules applied regarding warning shots than actually valuing your lives.  To clarify, warning shots are to be used when a helicopter is too high or far for the occupants to hear those on the ground. In this case, you were actually on the ground, and at a low enough altitude throughout to hear their demands. Warning shots were not necessary on this occasion. 

 
There  is very little i can say to this as i was not the pilot.

I wont excuse myself as i could of told him to fly away, but i didn't.

I was however confused about whether they were going to warning shoot the helicopter or my life hence why i was talking in TS. 

I was confused as to whether this was RDM or fail RP as there was no clear initiation on our lives or warning shoots given.  After speaking to Robbie i was told that i was hiding behind the Rules by hovering there.   This i can understand and can only apologize  for and it will not happen again.

I did not make the report off the back of no initiation. I made it because i was executed with terrible RP.  I understand i could of asked my friend to fly away that could of lead to the whole situation being avoided. I however did not do this as i was still sat there scratching my head over what was happening. I was not even thinking of getting my mate to fly away as i had no control over that.

Okay. To clarify, someone pointing a gun at you (or your heli) and threatening to shoot is a threat to your life (whether their RP is good or not) and you need to treat it as such. 

There's no rule that states they must 'tell' you the threat is to your life. Pointing a weapon at you (in the raised position) and ordering you do to something is a threat to your life.
