No. For all you know, they could be repairing your car for you. Breaking into a car and lockpicking it have the same animation. Breaking into a house still needs compliance. You can't just see someone breaking into your house and be like 'Hands up or die!'
For example;
Sir, can you stop what you are doing please. If you don't then force will have to be used (point a weapon at him)
Sir, stop doing what you are doing now! I have a pistol which is loaded, I don't want to do this.
Sir, for the 3rd and final time, stop what you are doing! I have a pistol, lethal force against you will be used if you do not stop. Stop NOW!
