Bank robbery + RDM

I will base these questions around an event:

Yesterday, a buddy and I were robbing a bank in east Altis. Almost immediately the UNMC arrived by airlift, with heavy arms and armour. They shouted that we should surrender. We refused and told them to back off. They stormed the building and we were killed.

• If we had not replied to the UNMC and opened fire on them when they breached the building. Would that be considered RDM?
• If we had planned better and positioned a person with a rifle somewhere in the near distance, overlooking the bank we were robbing, would he had been allowed to engage the UNMC when they breached the building?

I'm new here and I have been banned for RDM once. I don't want to risk doing anything that can get me banished from the island.
